A covered entity may let a business associate create, receive, maintain or transmit electronic PHI only if it obtains satisfactory assurances, documented in a contract that meets 164.314(a), that the business associate will safeguard it.
Business associate agreement
No public evidenceThe BAA is the contract that gives the satisfactory assurances the Security and Privacy Rules require.
The contract must require the business associate to comply with the Security Rule’s applicable requirements and to ensure its own subcontractors agree to the same.
Independent security assurance
No public evidenceA current SOC 2 report or ISO/IEC 27001 certificate is the usual evidence that a supplier operates appropriate security measures.
A business associate must notify the covered entity of a breach of unsecured PHI without unreasonable delay and no later than 60 calendar days after discovery.
Incident response and notification
Available on requestAn incident response plan or a published notification commitment shows how and when the supplier tells customers about incidents.
