PROCESSOR Built on enterprise-class data centers and infrastructures, Ntirety provides a variety of managed cloud and colocation services to its clients. Services include monitoring, patching, intrusion detection, logging, threat and vulnerability management, encryption, backup, compliance, database management and business intelligence. Currently Ntirety’s clients with international presence and EU operations make up a small but growing percentage of clients. As a processor, Ntirety provides infrastructure and cloud services to clients based on instructions from the client. In the provision of these services Ntirety does not directly access any client personal data. As the database management and business intelligence services evolve, access to personal data may change. However currently the model remains built on no-access to personal data. There are approximately 12 international clients that transfer EU data to Ntirety’s US and Canadian based data centers. Technically the cross border transfer is the responsibility of the client (controller). However, Ntirety’s Master Services Agreement (MSA) obligates that the client inform the Company of EU data so Ntirety can ensure the proper GDPR controls and adequacy mechanisms are established. Ntirety provides services to clients under an MSA that requires a) the client inform Ntirety of the processing of EU personal data and b) the two parties to execute a Data Protection Agreement and Standard Contractual Clauses in compliance with GDPR. CONTROLLER As a data controller, Ntirety collects personal data using several methods. • Form based input is data provided directly by data subject. It is used to communicate with the subject, and provide information about products and services, industry publications and promotional materials. • Tracking software collects traffic data to improve the site content and user experience. • Data collected by cookies is used to manage sessions and track activity for security and maintenance reasons. • Data collected from third party services is used to supplement existing data and qualify prospects and leads. Data is stored in various Sharepoint sites, portals, databases and at third party providers, such as Salesforce. As a controller, Ntirety processes personal data for user communications, website management and, customer and prospect management. Cross-border data transfer. The Company relies on the data subject’s explicit consent via the Privacy policy for the lawful transfer of EU data to the US. Data protection contract. As the controller, EU data subjects provide Ntirety with personal data under the terms of the privacy policy established on the website. We process employee data for human resources, payroll and benefit purposes.
