Scope
Paycom receives personal data and human resources data from or on behalf of our clients (employers) and their personnel regarding their personnel and their personnel’s dependents and family members. Such information is required for us to effectively provide our services (for example, payroll processing and human capital management) to our clients, and may include social security numbers, payroll information, tax information, and other information our clients may provide in order for us to perform our services (collectively, “client data”). Paycom does not share client data with a third party unless it is necessary to provide services on behalf of our clients. Paycom shares client data with the client and any third parties as instructed or permitted by the client. Paycom may also share client data with other third party data processors who facilitate our provision of the services requested by the client and who are prohibited from using client data except for such purpose. Paycom may also be required to share client data with applicable government entities (for example, the IRS, state unemployment agencies, state income agencies, workers compensation auditors, 401k administrators and entities who participate in the NACHA program for funds transfer purposes) or as otherwise required by law.

What GDPR means, and what it does not

"GDPR compliant" is a claim, not a certification. The verifiable facts are a public DPA, SCC usage, an EU representative, data residency options and a Data Privacy Framework listing.

Questions buyers ask

Is Paycom GDPR compliant?

There is no GDPR certification in general use. The verifiable facts are a public data processing agreement, standard contractual clauses, an EU representative and a Data Privacy Framework listing. See the legal artefacts and the DPF row on this page, each with its capture date.

How does CertReports verify this?

Every state carries a capture date, a source and a snapshot link. Registry rows come from the official registry data; vendor statements come from the vendor’s own page or trust centre; nothing is inferred. Vendors can dispute any row and corrections ship within two business days.
