- Proactive will use personal information to provide services and products requested by Clients and Visitors, market products and services to Clients and Visitors, and enable its vendors, contractors and partners to provide and assist Proactive in the marketing and provision of such services and products to Proactive, our Clients or our Visitors or to participate in joint marketing efforts, including marketing programs that provide preferential pricing on services and products. Proactive collects customer and visitor data. If Clients purchase products, or request pricing for products, offered jointly by Proactive and one of our partners, personal information may be received and shared by both Proactive and our partner. Proactive may also use and disclose personal information to investigate and help prevent potentially unlawful activity or activities that threaten the integrity of our service or network, as required by courts or administrative agencies or in connection with a sale, merger, or reorganization of Proactive’s business. For certain products, Proactive serves as a service provider to its Customers. In our capacity as a service provider, we will receive, store, and/or process data owned and/or controlled by our Customers. In such cases, we are acting as a data processor and will process the personal information on behalf of and under the direction of each particular Customer. Services Data is distinguishable from Customer Data, because it is data and information that may reside on Proactive, Customer or Third-Party servers, desktops, or systems to which Proactive is provided access to perform its processing services. Services Data may include Third-Party Personal Information about a Customer’s employees, clients, customers, partners, agents, suppliers, or other individuals (collectively “Customer’s Parties”). Proactive treats Services Data as confidential in accordance with the terms of the Customer’s contract. Proactive is provided access to such information under the direction of its Customers, serves solely in the capacity of a data processor, and has no direct relationship with individuals that are Customer’s Parties. Proactive does not collect this data and does not inspect the content of data collected by our clients.
