- Spigit offers so-called Software as a Service (SaaS). Spigit's product comprises solutions for innovation development and processes, comprising planning, tracking and status reporting for the purpose of decision making and processes. Customer created content in the systems may relate to personal data. The purpose of processing personal data is to fulfill the commitments of the service agreement with customers. Processing of personal data also takes place when marketing the company's different products. The customer's are disposed globally, mainly US and Europe. Third parties that processes parts of the services are disposed in US and EU. They are processing personal data to provide the contracted services and identify events and activities between computers and agents (such as browsers) on the Internet (e.g. determining whether an action on a website is being performed by a human or a Bot) or other identify patterns that may indicate malicious or fraudulent activity. Third parties also serves a service for security and operational information and event management system; aggregates system, infrastructure, and application log data for use in security, operational monitoring activities performed by Planview staff, and for email SMTP relay. - Under the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Planview processes personal data of business contacts and representatives of customers, prospects, vendors and partners; customer product users; website visitors, community/forum and event users; and other individuals whose data is submitted by customers or appears in customer content. Purposes and data processed include: • Service delivery and support (as a processor under customer instructions and a DPA): providing, hosting, maintaining, securing and troubleshooting Planview SaaS products; professional/implementation services, integrations, customer/partner training and customer success; and responding to support requests. Data may include names, business contact details, company, job title/role, user IDs and credentials, project/task, user-generated and other customer-submitted content, communications, support tickets, attachments, configuration data, product usage/performance data, logs, IP/device/network and location information, and other personal data customers choose to place in the services. • Product improvement, quality, security, usage and trend analytics, and AI/ML feature development. For Planview’s own analytics/development, data is minimized and, where feasible, pseudonymized, aggregated/anonymized or synthetic; customer data used to provide services remains subject to the customer’s instructions and applicable DPA. • Sales, marketing and business development: managing customer, prospect and partner relationships; lead generation and contact enrichment; communications and direct/digital advertising; website operation, analytics, personalization and online activity tracking; communities/forums; events, webinars, sponsorships and event follow-up; and market, industry and campaign analysis. Data may include contact/professional information, company and role, engagement and event participation, survey responses, web/cookie/device/IP/network activity, and audio/video or call recordings where applicable. • Commercial, finance, procurement and legal administration: negotiating and performing customer, vendor and partner contracts; order management, billing, invoicing, collections, accounting, tax and financial reporting; supplier onboarding and management; dispute resolution, litigation, legal advice, compliance, corporate governance, privacy/risk management, and responding to lawful requests. Data may include names, contact details, professional information, contract/order/subscription and transaction data, invoices and business payment/billing information, signatures, correspondence and documents, and data relevant to legal, regulatory or compliance matters. We may disclose personal data, as needed for these purposes and subject to applicable safeguards, to Planview subsidiaries and affiliates and authorized personnel; customers from whom Planview received the data; cloud hosting, computing, storage, security, monitoring, support and other technical service providers; CRM, sales engagement, marketing automation, advertising, analytics, collaboration, event, training, e-signature, accounting, tax, payment and social media service providers; contractors, consultants, professional advisers and other agents/sub-processors; and business partners, event sponsors and partners. We may also disclose data to counterparties, courts, regulators, government authorities or other persons when required or permitted by law, under customer instructions, or with consent, and to other website users when an individual posts content in an interactive area of a Planview website.
